TERMS & CONDITIONS
The terms that apply to every Aqua-Fly session and to this website
1. Who We Are
Aqua-Fly (“Aqua-Fly”, “we”, “us”) operates flyboarding sessions from the Aqua-Fly Dock, Bahar ic-Caghaq, Naxxar, Malta. You can reach us at info@aqua-fly.com or on +356 9937 4612 (phone / WhatsApp).
These terms apply when you book or take part in an Aqua-Fly session and when you use this website. By booking a session or participating in one, you agree to them.
2. Our Sessions
We offer instructor-led flyboard sessions — Solo, Duo and Trio flights as listed on our Book a Session page, and tailored group packages by individual quote. Every session includes full safety equipment (life jacket and helmet) and a qualified instructor.
Our season runs April through November. All sessions are subject to sea and weather conditions and to instructor availability.
3. Bookings & Payments
Sessions are currently booked by phone or WhatsApp, or in person at the dock; payment is taken on site unless we agree otherwise with you. The prices shown on the Book a Session page are in euro (€). Group packages are priced individually — contact us for a quote. A booking is confirmed once we have agreed a date and time slot with you.
4. Cancellations, Refunds & Weather
Cancellations made more than 24 hours before the scheduled session time may be rescheduled or refunded. No refunds are issued for cancellations made within 24 hours of the scheduled booking time. This mirrors the cancellation policy in the activity waiver every participant signs.
Flyboarding is weather-dependent. If we have to cancel or cut short a session because of sea or weather conditions, equipment issues or any other safety concern on our side, we will offer you a replacement slot or a refund of what you have paid for the affected session. The instructor's judgement on whether conditions are safe is final.
5. Participation Requirements
Every participant must read and sign the Aqua-Fly flyboard activity waiver before flying — online on our Sign the Waiver page or on paper at the dock. Participants under 18 require the consent of a parent or guardian, as set out in the waiver.
Participants must be in good physical health, able to swim competently, and must meet the eligibility requirements published on our Safety Disclaimer page. We may refuse or end a session, without refund, where a participant does not meet these requirements, does not follow the instructor's directions, or appears to be under the influence of alcohol or drugs. The Session Rules on the Safety Disclaimer page form part of these terms.
6. Safety & Conduct
You must follow all instructions given by your instructor, wear the safety equipment we provide for the full duration of the session, and stay within the session area. The instructor controls the throttle and the session at all times and may stop a flight at any moment if safety requires it.
7. Liability
Flyboarding is an extreme water sport with inherent risks, which each participant accepts by signing the activity waiver. Our liability to you is limited as set out in the signed waiver. Nothing in these terms or in the waiver excludes or limits any liability that cannot lawfully be excluded or limited. We are not responsible for loss of or damage to personal belongings brought to the dock or into the water.
8. This Website
The content of this website is provided for general information about our sessions. We keep it as accurate and up to date as we can, but we do not guarantee that the site is always available or error-free. The Aqua-Fly name, brand and site content belong to us — please do not reuse them without our permission. Links to third-party services (such as WhatsApp, social networks and maps) lead to services with their own terms, which we do not control.
9. Changes to These Terms
We may update these terms from time to time. The version published on this page when you book or take part in a session is the version that applies to it.
10. Governing Law
These terms are governed by the laws of Malta, and the Maltese courts have jurisdiction over any dispute connected with them. If you have a problem, please contact us first — we will always try to sort it out directly.
